Our team helped This client purchased cargo transportation insurance when transporting energy equipment valued at RMB 7.2 million to a Chinese manufacturer, with the cargo's final destination being in Europe. However, losses occurred during the transportation, leading the consignee to claim a total loss. Furthermore, the manufacturer (sender) withheld the customer's freight and initiated a claim against the customer. To address this complex situation, we organized discussions involving the client, the manufacturer's engineers/head of the international business department, a public assessment company, and the insurance company. Together, we developed negotiation strategies, implemented damage control measures, and devised claims strategies. Through negotiations with the European consignee, an agreement was reached for the consignee to repair the cargo by replacing certain parts, effectively mitigating the overall loss and claim amount. In the end, the insurance company settled the claim for RMB 2.13 million.
At the same time, the client was exempted from the insurance company's pursuit of a claim due to the specific terms outlined in the cargo transportation insurance arranged for the client. These terms explicitly stated that the insurance company would forego recovery on behalf of the policyholder (client).
